CALL= TO ORDER: &= nbsp; The meeting was called to order by the president, Chris Barkley, at 2:02 p.m., in Room SU-30.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; There was discussion on the recent elections using the electronic voting. Electio= ns Committee Chair Stan Levy announced that the committee would be using that format in future elections. Brief discussion followed.

Moti= on 2 &= nbsp; &nbs= p; MS Dowd, Cater: Faculty Senate approval of BP 3420 – Unlawful Discrimina= tion.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; Lengthy discussion followed on the changes proposed by the Faculty Senate at its November 4^th meeting. Jack Miyamoto has indicated that the new policy will get the District in line with Title 5 regulations and the Senate’s recommendation that union activities be listed as a protect group in this policy is inappropriate. This is not a protected group that should be listed there. He also indicated that the District and the PFF hav= e a tentative agreement on the Non Discrimination Article that lists other protected groups. This is appropriate and serves the purpose of allowing fo= r a grievance to be filed against the District should it violate any article of= the contract. Regarding the Senate’s recommendation for a standing commit= tee, Dr. Miyamoto indicated that the District is responsible and accountable for= the handling of all discrimination complaints and will make the necessary decis= ions on how the investigations of each complaint will be handled. This is not a shared governance activity. There are also individual privacy issues involv= ed that would be compromised should such a committee to convened to discuss ea= ch complaint.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; MaryAnn Drinan proposed the following amendment to Motion 2:

Moti= on 2 (Amended) &nbs= p; MSC Drinan, Levy: Faculty Senate approval of the following amendment to the Unlawful Discrimination Policy:

= 1. &n= bsp; A replacement of the wording in the second sentence so that it will read “Equal opportunity is offered t= o all employees and applicants for employment including (but not limited to) = then include additions to the list that expands unlawful discrimination to inclu= de medical condition, marital status, political affiliation, veteran status, and protected union activities under EERA.

= 2. &n= bsp; Replacement of “any program or activity that is administered by, funded directly = by or that receives any financial assistance from the State Chancellor or Boar= d of Governors of the Ca CC’s with any program or activity under California state or federal law or regulation.

= 3. &n= bsp; The addition of the following statement at the end of the first paragraph: This policy is subject to the provisi= ons of any collective bargaining agreement between the District and an employee bargaining agent.

MaryAnn Drinan sta= ted that the language in the current policy is somewhat confusing, because it references Title V and much of the references in Title V refer to students bringing forward various complaints rather than employees.

Item #1 would allo= w any changes in the law which may occur to become part of our own policy. Relati= ng to Item #2, it can be confusing to have these protections but only for those programs that receive financial assistance from the State Chancellor or Boa= rd of Governors. It’s confusing because some of the programs that we have are funded by the federal government so a broader statement is needed. Item= #3 adds wording to recognize that there is a negotiable element here. Lengthy discussion followed on the proposed amendment.

There was some con= cern expressed about some of the language listed in the document belonging in the “Procedure” rather than the “Policy.” Policy should= be succinct and limited, and the procedure should list all of the details.

= &nb= sp; = &nb= sp; The following substitute Motion was offered:

Moti= on 2 (Substitute) &= nbsp; MSF Dowd, Laughlin: Faculty Senate approval of an amendment to BP 3420, Unlawful Discrimination, to include only the first and fourth paragraphs of the document, and that the remainder of the wording be added and included in the Procedure. Motion failed.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; Brief discussion followed on the substitute Motion.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; Senate members agreed that if the amendments suggested in Motion 2 are not accepte= d by the members of the Strategic Planning Council, all faculty members on the Council should vote against approval of the policy.

BP 5= 120 – Transfer

Cent= er: &= nbsp; &nbs= p; &= nbsp; John Erickson spoke of Palomar College’s history in the development of Transfer Centers, the Tra= nsfer Center concept, and= the development of legislation that led to their establishment.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; Currently, the Director of the Career Center and the Director of the Transfer Center are full time faculty on special assignments. The qualifications listed in = the proposal for a Counseling Services Supervisor do not fulfill the needs of a Transfer Center here at Palomar. It totally eliminates the input of a qualified professional person to develop and mana= ge these programs and activities. Education Code section 51027 requires the governing board of each community college district to recognize transfer as= one of its primary missions, and that an emphasis shall be placed on the prepar= ation and transfer of underrepresented students. Additionally, each district was = to develop and adopt a “transfer center plan” which would describe= the activities to be provided to students. Initial plans to implement minimum standards were to be directed towards, but not limited to, five areas: serv= ices to be provided to students; facilities; staffing; advisory committee; and evaluation and reporting.

Lengthy discussion occurred on supporting the continuation of the Transfer Center as it currently exists, which includes programs that have been in place here over the past 25 years. Senate members expressed concern with the de-professionalization of clearly an academic position.

Also discussed at = length was the high number of changes being proposed in the Instruction, Student Services, and Technology areas. Sufficient time = to seriously consider all the changes is not being provided as these issues can and will have lasting impact on faculty and staff members. One Senate member also pointed out that when Dr. Amador attended the November 4^th Senate meeting, she agreed to provide a statement stating specifically how = any proposed changes will benefit students and provide a better education at Palomar College. No rationale for these ch= anges has been provided. Senate members agreed to request a moratorium on Instruction-related reorganizations until additional discussion can occur on these issues.

Motion 6 = M= SCU Dowd, Towfiq: The Faculty Senate considers Instructional-related reorgranizations to be an Academic and Professional matter. Therefore, the Faculty Senate requests a moratorium on Instruction-related reorganizations until we have had the opportunity to adequately address these situations.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; Senate members directed Chris Barkley to write a letter to the Superintendent/President clearly defining these issues as academic and professional matters stating that the Senate needs time to consider and dis= cuss them.

ASG:= &= nbsp; &nbs= p; &= nbsp; Sean Weimer reported that a food drive will be held after the holidays in an att= empt to restock the food pantry.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; Faculty are being encouraged to send in any goals they= think the students should discuss adopting for next semester.

Othe= r: &= nbsp; &nbs= p; &= nbsp; Chris Barkley reported that the Hiring Policy is listed on the Strategic Planning Council agenda for approval. The Faculty voted by a 2 to 1 margin to reject= the proposed policy as well as the proposed procedures. There are existing poli= cy and procedures which should be followed until they are replaced. She added = that she has contacted the other employee groups to ask them to agree to support postponing this item.
