CALL TO ORDER: = The meeting was called to order by the president, Chris Barkley, at 2:00 p.m., in Room SU-30.

Approval of Minutes: = The minutes of Septe= mber 23, 2002, were approved as amended.

Motion 1 &nb= sp; = MSC Voth, Cater: Faculty Senate approval of the following committee appointment:

&n= bsp; = ; &n= bsp; = ; Suzanne Grenz, Economics, History, & Political Science (replacing Kathy Pine)

Faculty Advocacy: = This item was postponed until the October 14, 2002, Senate meeting.

Child Care Center

Fees:

Motion 2 &nb= sp; = MSC Cater, Garlow: Faculty Senate support of the following recommendations being made by the Child Development Center:

= · = The elimina= tion of the 10% sibling discount at the Child Development Centers, effective November 1, 2002.

= · = Within thir= ty days from notification from the state, the Centers will automatically adjust parent fees, full and part-time, of non-subsidized children to match the st= ate daily reimbursement rate received for subsidized children.

Jonnah Laroche <= /p>

Award:

Motion 3 &nb= sp; = MSC Key, Dolan: Faculty Senate acceptance of the results of the ballot recommen= ding Laura Raty as Palomar College’s can= didate for the Jonnah Laroche Memorial Scholarship.

Curriculum:

Motion 4 &nb= sp; = MSC Laughlin, Cater: Faculty Senate ratification of the work of the Curriculum Committee.

Accreditation Report: &= nbsp; Comments on the recent Sunshining of the Accreditation Standards documents have been received from several faculty members. Senate members agreed that the comme= nts should be forwarded to the Co-chairs.

<= /span>

Motion 5 &nb= sp; = MSC Cater, Miller: The Faculty Senate will forward the comments received during= the Accreditation Self-Study sunshining process to the Co-Chairs with a request that all suggested changes be seriously considered and the appropriate chan= ges made. The Co-Chairs are asked to indicate to the Senate which of these suggestions will be incorporated into the Accreditation report as well as a rationale of which changes will not be made and why.

E-Mail Distribution: &= nbsp; The issue of one or more faculty member’s emails recently being tapped in= to and distributed was brought forward for discussion.

Motion 6 &nb= sp; = MSCU Key, Spear: The actions of those who would tap into and distribute private = Faculty email are illegal and ethically indefensible. The Faculty Senate condemns in the strongest terms possible the actions of the individual or individuals responsible and demands that they cease this activity immediately.

&n= bsp; = ; &n= bsp; = ; Steve Spear provided the Senate with legal documents highlighting the seriousness= of the infringements on faculty privacy.

&n= bsp; = ; &n= bsp; = ; California Penal Code Section 631 (a). Any person who, by means of any machine, instrument, or contrivance,= or in any other manner, intentionally taps, or makes any unauthorized connecti= on, whether physically, electrically, acoustically, inductively, or otherwise, = with any telegraph or telephone wire, line, cable, or instrument, including the wire, line, cable, or instrument of any internal telephonic communication s= ystem, or who willfully and without the consent of all parties to the communicatio= n, or in any unauthorized manner, reads, or attempts to read, or to learn the contents or meaning of any message, report, or communication while the same= is in transit or passing over any wire, line, or cable, or is being sent from,= or received at any place within this state; or who uses, or attempts to use, in any manner, or for any purpose, or to communicate in any way, any informati= on so obtained, or who aids, agrees with, employs, or conspires with any perso= n or persons to unlawfully do, or permit, or cause to be done any of the acts or things mentioned above in this section, is punishable by a fine not exceedi= ng two thousand five hundred dollars ($2,500), or by imprisonment in the county jail not exceeding one year, or by imprisonment in the state prison, or by = both a fine and…

&nb= sp; = &nb= sp; = B. Faculty members shall use District equipment, supplies, utilities, faciliti= es, or vehicles only for purposes related to the performance of their duties,…

&nb= sp; = &nb= sp; = C. …Faculty members shall aspire to excellence.

&nb= sp; = &nb= sp; = BP 300.1, Statement on Professional Ethics. Palomar College believes th= at the “Statement on Professional Ethics,” promulgated by the American Association of University Professors and adopted by the California Academic Senate, serves as a reminder of the variety of obligations assumed by all members of the academic profession. These standards should become an integr= al part of each faculty member’s personal and professional life.

&nb= sp; = &nb= sp; = …They accept the obligation to exercise critical self-discipline and judgment in using, extending, and transmitting knowledge.

&nb= sp; = &nb= sp; = …As colleagues, faculty members have obligations that derive from common member= ship in the community of scholars. Faculty members do not discriminate against or harass colleagues…

&n= bsp; = ; &n= bsp; = ; Lengthy discussion occurred on what the district’s role should be in securing= the privacy of faculty email. Senate members agreed that email should be secure= d, but that the district should investigate and follow through in this instanc= e.

Motion 7 &nb= sp; = MSC Bedford, Sourbeer: Amend Motion 6 to remove the last sentence: Further, the Faculty Senate urges the Governing Board to direct the District to take any= and all appropriate action to insure that it never happens again.

&n= bsp; = ; &n= bsp; = ; After additional discussion, the following substitution was offered for Motion 7:=

~~Motion 7~~ &nbs= p; &= nbsp; &nbs= p; MSF Levy, Cater: Amend Motion 6 to change the last sentence as follows: Further, the Faculty Senate urges the Governing Board to direct the Superintendent/P= resident to take appropriate action against any email theft while doing everything possible to protect the privacy of all individuals. Motion Failed after a recount.

&n= bsp; = ; &n= bsp; = ; Senate members discussed what an “appropriate action” by the Superintendent/President would be in this instance. Giving direction to how= a matter such as this should be handled could be beyond the Senate’s responsibility.

Hiring Procedures: &= nbsp; Copies of the most recent draft of the Faculty Hiring Procedure were distributed f= or review. Chris Barkley indicated that in an effort to give faculty members m= any opportunities to provide input, the document will be sunshined, as well as presented for discussion at the October 2^nd Faculty meeting. Sen= ate members also agreed that the October 7^th Senate meeting should f= ocus solely on the Hiring Procedures. A poll of the Faculty could be conducted a= fter the Faculty Senate and Faculty meetings asking for approval or non-approval= of the proposed new procedure. Lengthy discussion followed on the proposed cha= nges.

Proposed Technology

Restructuring Letter: &= nbsp; Copies of the letter sent to the Superintendent/President expressing the Senate’s concerns about the possibility of hiring a Vice President of Learning Technology and Information Services were provided. Chris Barkley indicated that a response from Dr. Amador is expected by Wednesday indicati= ng that she is postponing discussion on any proposed technology restructuring = at this time at the Strategic Planning Council. The Librarians will also be as= ked to participate in the decision-making process.

Faculty Senate Elections

Committee: = &nb= sp; Chris Barkley referred to a letter from a faculty member who was concerned that t= he recent elections to the Tenure & Evaluations Review Board may not have = been conducted properly. Stan Levy reported on the current methods used by the F= aculty Senate Elections Committee, including asking Senators to fill in counting t= he votes on some of the smaller elections, such as divisional representation o= n a committee, when members of the committee aren’t available. All other elections conducted by the Faculty Senate Elections Committee are done usin= g at least three members of the committee.

&n= bsp; = ; &n= bsp; = ; Senate members agreed that the Chair as well as the members of the Elections Commi= ttee can decide how they will handle the soliciting of volunteers to count ballo= ts, and since the ballots can be verified by any faculty member who wishes to d= o so, this particular election as well as all elections by the Faculty Senate Elections Committee are legitimate.

Other: = ; &n= bsp; Chris Barkley referred to a memorandum she received from a faculty member relatin= g to the current policy regarding Senate membership. The Constitution states that when a Senator takes a leave the position shall be declared vacant. Because there is currently a member of the Senate who is on sabbatical leave, that position will become vacant effective immediately and a call for nominations will be sent out to faculty members.

ASG: &= nbsp; &nbs= p; &= nbsp; Jason Roach provided the following report of the ASG:

= · = Voter Registration will occur on campus soon.

= · = Plans are underway for the Comet Celebration.

= · = Members of = the ASG are preparing to travel to Sacramento = and Florida.

Non payment of Fees: = Responding to an inquiry from a faculty member on why students are being dropped from = all of their classes if they add a class but do not pay for it, Chris Barkley indicated that Herman Lee responded that we dropped about 2,300 students for non-payment of fees. Less than 50 students who owed fees were dropped by fa= culty as no-shows; only 10% were reinstated with faculty approval as of Wednesday, September 25, 2= 002.
