Planning Council meeting:

The Matriculation and Transfer Advisory agre=

to fund $5,000.00 to provide stipends to Faculty to manage the Palomar
Mentors Program. John Woods announced that he would contact Kevin Barre=

and Morgan Peterson regarding managing the program.
Food Services Advisory Committee – Bruce Bishop reported that =
the
FSAC meets 2pm on the third Wednesday of the month and needs regular faculty
and staff attendance. Bruce reported the Food Services lost $140,000 last y=
ear
and this was due to labor costs. After November 1st Food Services
will be closed between 4-6pm as a cost savings measure. Bruce also stated t=
hat
online ordering for food would be available for faculty and staff beginning=
in
the spring semester.
Bookstore Advisory Committee- Bruce Bishop repo=
rted
that Follett will be given a 5 year renewal on their contract with Palomar.
Bruce also reported that there is a problem with faculty getting their
bookstore orders in on time. Bruce stated that only 12% of bookstore orders
were turned in on time this semester and noted the problems this causes
students.
Admissions – Herman Lee reported that stude=

can now view and print their unofficial Palomar transcript showing coursewo=
rk
from 1983 to present.
Health Services – Jayne Conway reporte=

the appropriate number to call regarding a student in crisis (suicide threa=

is the Campus Police at ext. 2289. The Campus Police dispatch will direct t=
he
call to Health Services if the office is open.
Counseling—Jose Hernandez reported that
counselors will be providing walk in service for students from November
15-February 15th. During the registration period there will not =
be
appointments made and students will be seen on a first come basis for full
service walk-in.
Fiscal Services

Up to 36 Professional Development hours for
attending Governing Board meetings was recently approved by the PD board.

The board has approved 1 Service Point per semes=

for Palomar Faculty Federation (PFF) committee service, and 2 Points per
semester for PFF leadership service.

The 1999 publication of “The Guide” =
has
been reviewed and compared with the current PD workshop publication to check
for possible inconsistencies. The most current Guidebook was published in 2=
001
and is currently listed on the Professional Development website. This Guidebook is being followed b=
y PD
as current PD procedures. It =

also reported that no significant differences exist between the Guidebook a=
nd
the fall 2004 PD workshop publication.
She added that because the spring 2005 workshop publication will go to
print in the next two weeks any changes which the Senate wishes to recommend
need to be reported as soon as possible.
This item will be brought back for Senate action on November 8.

committee met September 30, 2004,<=

discuss the appointments of permanent staff and/or part-time instructors to
fill vacancies on committees.
1. We unanimously agreed that permanent staff should not represent
faculty on committees.
2. We believe that part-time instructors should be able to serve on
committees. Ideally, we welcome the
participation of ALL faculty in committee work and encourage their service;
moreover, the Committee on Committees endorses the concept of all faculty
working together. However, questions rema=
in
about the compensation of part-time faculty for committee work. While full =
time
faculty are expected to serve on committees as part of their contracts, part
time faculty are not compensated for committee work in any manner.
Allowing part-time faculty to serve without compensation sets a bad
precedent. Do we want to suggest to the District that faculty will se=
rve
on committees for free and thus that both classroom and committee work can =
be
done by part-timers for a fraction of the cost of full timers? We
concluded that part-time faculty should not serve on committees until the P=
FF
can negotiate hourly pay for this service.

Senate member disagreed with the suggestion that part-time faculty not serv=

committees until hourly pay is agreed upon. Although the PFF is currently
negotiating compensation for committee service for adjuncts, they should no=

some discussion, it was reiterated that the document was created to provide
clarification on what should happen when a full time faculty member could n=
ot
be found to fill a full time vacancy on a committee and whether or not a pa=

time faculty member could be appointed for such a vacancy. It was agreed that adjunct faculty =
should
not have the same committee load as the full time faculty, without compensa=
tion
for filling those slots.

Outcomes Council and the Curriculum Committee as the person or organization
assigned as lead. This would allow the “Campus Wide Teaching Theme=

to become institutionalized and ensure that any emphasis on teaching themes
remain under the direction of the Academic Senate as an Academic and
Professional Matter. There was concern that the issue not be bogged down in
governance process. In respon=

this concern, It was suggested that the item could probably move rather qui=
ckly
through the process. Senators agreed that it should go through the process.=

Townsend-Merino indicated that Interim President Jones would like to begin =
the
process of filling the VP of Human Resources position soon. Members of the
Fiscal Stability Task Force have been attempting to address this position a=
long
with other vacancy replacement processes since it began its work in the
summer. Information is being
gathered related to whether or not the position should be at the vice presi=
dent
or director level. Katie reported that it is believed that there are a simi=
lar
number of colleges in the state that have directors overseeing Human Resour=
ces
as there are those that have vice presidents. FSTF is gathering information regar=
ding
our comparable colleges, which will be discussed in Group 3 of FSTF at its =
next
meeting. There was also discu=
ssion
that if the position goes forward as a vice president, perhaps some workload
shifts could be made from other vice president areas to ensure better distr=
ibution
of workloads among the vice presidents.

Laughlin, Hohman: The Faculty Senate recommends that

discussion followed on suggestions made by Interim President Jones on how to
proceed with college business while the decision is being made on the posit=
ion,
including having just one planning council titled the Administrative Servic=
es
& Human Resources Council. Dr. Jones had indicated that he is concerned
about “symmetry” by having all four councils overseen by a vice
president. Senators discussed that given the fact that the current Human
Resources Planning Council rarely meets this did not appear to be a valid
argument for hiring a vice president. There was agreement that the worklo=
ad of
the position should be reviewed before the district goes out for the positi=
on
and concern was expressed that an Interim President would be rushing to make
such a long-term decision.

Dowd added that the Fiscal Stability Task Force is discussing the issue and
hopes to make a recommendation soon to SPC. Hopefully the district will not
move forward until those suggestions are made. Although our current interim

r, it
was suggested that perhaps another interim could be hired while the data is
being gathered and a recommendation forthcoming.

position and make recommendations be allowed to continue through the Fiscal
Stability Task Force. If the district feels the position should be filled
before the process is complete, the Senate recommends that another interim =
be
hired through the current consulting agency.

Academic Due Process
In response to complaints that faculty were
being denied access to the Academic Due Process procedure as outlined in the
faculty manual, the Professional Procedures Committee sent out an email to =
all
faculty asking them to report to the committee if such an action had occurr=
ed
to them.
Four individuals contacted the Professional
Procedures Committee regarding the issue of academic due process denials.
Case One
One of the full- time faculty members expres=
sed
concern regarding the comments that were written on the peer evaluation for=
m by
the interim Dean and VP for the division.&=
nbsp;
The faculty member felt that the comments were inappropriate. The faculty member spoke with the =
VP of
Human Resources to see what could be done.=
The VP of Human Resources spoke with the interim Dean and VP and the
comments were removed except for one negative remark. The faculty member al=
so
expressed concern regarding the signature page for the peer evaluation. The faculty member felt that the
individual being evaluated should sign the form after all information had b=
een
submitted. Even though this f=
aculty
member felt that they were treated unfairly, a formal request for academic =
due
process was not submitted. The
faculty member spoke with the individuals involved and the issue was resolv=
ed.
As due process was not requested, it
hasn’t been denied. The concerns regarding the tenure review signature
page have been addressed by TERB. If this faculty member does not feel as if
their concerns have been adequately resolved they may choose to ask for
Academic Due Process.
Case Two
The adjunct faculty member felt that the rea=
son
they were not hired was because of the attitude of the acting dean of
counseling at the time. The a=
djunct
faculty member submitted in writing to the committee what had happened. Even though they felt they were not
treated fairly, they did not formally ask for the academic due process to be
initiated.
As due process was not requested, it
hasn’t been denied. Additionally, this is an issue that would involve=
PFF
if the adjunct faculty member believes that they were treated unfairly.
Case Three
For one of the full-time faculty members, bo=
th
of the formal requests (one regarding tenure review evaluation and another
regarding work on a hiring committee) made by this faculty member for acade=
mic
due process were denied by the president of the college because “the
request did not meet the criteria for academic due process.” After reviewing the policy and
procedure, it is not clear why the request was denied. There is no provision in the polic=
y that
outlines what requests CAN be denied.
It states that this procedure applies “to actions which interf=
ere
with and/or exert a harmful effect upon the functions of the College and may
involve faculty, administrative staff, classified staff, and/or
students.” In addition,=
for
the request involving the tenure and review process, it states in the tenure
and review policy and procedure, in more than one place, that academic due
process can be applied for at any time.&nb=
sp;
In this case, due process was clearly requested and denied inappropriately. As
the current interim President has reaffirmed that the Academic Due Process
policy will be honored as it exists in the Faculty Manual, this faculty mem=
ber
has every right to enter a new request for Academic Due Process if they so
choose.
Case Four
The other faculty member applied for academic
due process concerning tenure review evaluation procedures and process. The
process was initiated. It too=
k some
time to find an ombudsperson that all parties could agree upon. After the ombudsperson was chosen,=
that
individual met with both the members indicated in the request. The meetings took place at the end=
of
the spring semester. The facu=
lty
member who initiated the process was contacted by the ombudsperson. During that conversation, the facu=
lty
member indicated that they would be out of town for the summer and asked if=
the
process could be postponed until they returned in the fall. The ombudsperson stated that that =
would
be ok. When the person return=
ed,
they found out that the process had been stopped because the proper forms w=
ere
not submitted by the due date. The
faculty member was unaware that the forms needed to be submitted before they
returned. Based on the conver=
sation
with the ombudsperson at the end of the semester, the faculty member thought
that the process would be extended until they returned. The ombudsperson does not recall t=
he
conversation
Even though this process was initiated, beca=
use
of unclear communication, the process did not give the faculty member who b=
egan
the procedure the opportunity to see it through to the end. As there is no documentation of the
conversation in question that could clarify for the committee what was said,
the Professional Procedures Committee members feel that this faculty member=
has
a right to reinstitute their request if they so choose.
Board Policy on
Professional Procedures can be found on page 30 of the Faculty Manual, and =
the
Procedure can be found on page 94 of the most recent printed copy.
Marilee Nebelsick-=
Tagg
reported that the committee sent out a memo last semester to faculty member=
s regarding
academic due process and whether anyone felt they had been denied access to
this process. The four responses received are outlined in the report above,=
as
well as the committee’s recommendations.

Math/English
Requirements
for AA’s: &nbs=
p; Katie
Townsend-Merino reported that she attended the Statewide Academic Fall Plen=
ary Session
during October 28 – 30. The possibility of raising the minimum, Title=
5
prescribed graduation requirements in English and Mathematics for students
being awarded an AA or AS was one of many issues discussed. The item was
postponed until the spring session to allow for more input. Discussion foll=
owed
on Palomar’s current requirements.
