Appr= oval of Minutes: &n= bsp; The minutes of May 2, 2005, were approved as amended.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; Barb Kelber indicated that with regard to a report made at last week’s mee= ting on the Ford Foundation Grant for Campus Explorations “05-06: Ethics,” the amount of allowable overhead to be charged against the $= 100,000 should have been reported as 10% rather than 11%.

Publ= ic Comments: &nbs= p; Shannon Lienhart read the following statement:

&= nbsp; &nbs= p; &= nbsp; &nbs= p; On April 26 – 28 and on May 2 a hearing was held on this campus in front= of an administrative law judge concerning Dr. Roya Lahijani, the Life Sciences Professor who was recently denied tenure. I was the PFF designated observer during that period and wanted to bring that report to the Senate.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; California Education Code gives Roya the right to a hearing before an administrative l= aw judge. Roya’s contention was that the stated procedures that governed= her evaluation process were violated. The PFF’s role in this proceeding w= as to ensure that Roya received the due process provided her by the Education Code. In a larger sense the PFF, as a faculty union, has been charged by the State Legislature with the responsibility of faculty evaluations. Plus the PFF’s role in this case was to ensure that both= the procedures and the evaluee were protected. The hearing was a formal judicial proceeding with an independent judge provided by the State of California’s Office of Administr= ative Hearings. A court reporter was present and called witnesses who were requir= ed to testify under oath. The district, as the prosecution, presented its case first and it consumed the first three days of the hearing. An experienced attorney who specializes in educational law represented the district. On the other hand, the defense only had one day to present its case. Moreover, Roya was not represented by an attorney but rather a CFT field representative wh= o had never appeared before an administrative law judge in this type of hearing. After hearing the testimony of all members of the Tenure Evaluations Commit= tee and of the TERB Coordinator and receiving all relevant documents, the judge ruled that the Palomar District’s evaluation procedure was not proper= ly followed by the Tenure Evaluations Committee and that Roya was denied a full and fair evaluation. The judge’s order reads: “The accusations served on respondent Roya Lahijani is to be dismissed and that respondent R= oya Lahijani shall be retained for the 2005-2006 academic year and she shall be= come a regular tenured academic employee.” For tenured faculty members the ruling of an administrative law judge is a binding legal decision. However because Roya is a probationary faculty member, the judge’s ruling is = only advisory. It is up to the Governing Board to accept the judge’s order= and in accordance with the law the Governing Board only has 10 days to make this decision. There were several crucial points that were made in this judgment: (This is a public hearing and the documents arising from the hearing are al= so public documents) 1. Although student evaluations are an important componen= t of the evaluation process, committees are required to consider other factors as well. The testimony presented indicated that the committee based the decisi= on to deny tenure entirely on student evaluations. 2. Although there was testi= mony that Roya’s student evaluations were below average for the district’s instructors, there was no evidence that anyone orally or in writing informed Roya of this standard and that it was an instrumental part= of her evaluation. 3. Roya was not informed of her student evaluations from fa= ll 2003, evaluations that her committee had in November of 2003, until May, 20= 04 (that would have been her third year student evaluations) thereby depriving= her of any opportunity to attempt to modify and/or correct her conduct. Up until May of 2004 the most recent notice she had been given by her committee was = that her performance was satisfactory. Finally, the judge ruled that the committ= ee decided to deny tenure without consideration of the required documentation = and without giving her a timely opportunity to remediate. In essence Roya was n= ot given the full evaluation period and in fact was given the false impression= in May of 2004 that she could improve. Her student evaluations for both summer= and fall 2004 did show improvement. The judge ruled that all of the information gathered by the committee after May, 2004 was not objectively evaluated by = the committee. The PFF presents this information to you for a variety of reason= s. First, TERB held its final meeting of the semester last Monday. Second, the Senate did hear information about this case earlier in the semester. And finally, the Governing Board will be hearing this judgment in Closed Session tomorrow night and has only 10 days from last Friday to respond.=

&= nbsp; &nbs= p; &= nbsp; &nbs= p; Sara Thompson spoke as a member of Roya’s committee, primarily as a faculty member but as everyone knows she has since become a dean. She indicated tha= t as Shannon just said, the ruling of the administrative judge is that Roya would be granted tenure. There is nothing= in the judge’s ruling for an extended evaluation or another evaluation. = Roya would be granted tenure. If the Governing Board accepts that then Roya beco= mes a tenured member of the faculty regardless of what the review committee has come up with. It’s not a matter of giving her more time or another ev= aluation; she would be granted tenure. She added that she felt Shannon did a very straightforward job of explaining what went on but that she did = find two irregularities in the process that concern her and that these concerns = are directed at the position and not the individual in the position. She stated= that she felt the Senate should look at whether or not in any position the co-president of the PFF should be on TERB, and she added that she felt that= it is highly irregular that the co-president of the PFF should be involved in = this hearing. She indicated that she felt it could lead one to think that it wasn’t quite as objective of a process as it might initially appear. = She referred to several things mentioned in the judge’s statement that the committee did not agree with. One of them was that the Standard for Evaluat= ion was not explained to Roya. From what the committee understood, what the jud= ge wanted was for them to give Roya a number. At 3.4 you have reached the standard, at 3.3 you have not. In that very limited context, that is true. = The committee never said specifically that she had to reach a 3.4 and if you ge= t a 3.3 we won’t recommend tenure. But it was made very clear to her of t= he kind of comments that were being received on an ongoing basis so that state= ment was slightly taken out of context. Dean Thompson further stated that Roya d= id not receive her evaluations in November because evaluations are given to the faculty member the following semester after they are collected when grades = have already been turned in to avoid any potential concerns on the part of stude= nts that may arise. She added that the Life Sciences Tenure & Review Commit= tee followed the directions outlined in the faculty manual; the fact that they = were followed was maintained by the TERB Coordinator who has been in place this year, as well as the TERB board in place this year. The committee has done = what was required by the Faculty Senate and requests that the Senate support the= m in the process. She added that she felt it would set a terrible precedent if at this point the Faculty Senate were to imply that faculty on the committee and/or on TERB did not do their jobs.

&= nbsp; &nbs= p; &= nbsp; &nbs= p; Rocco Versaci pointed out that the fact that he was Union President was disclosed= in his testimony so the judge was aware of it and the district did not raise a= ny objections to it.

She added that the new cont= ract also calls for only tenured faculty members to serve on the Sabbatical Leave Committee. It was suggested that the Vice President position be reduced to 10% because the individual in that position is unable to attend SPC or RAC due to a teaching schedule conflict= . Discussion followed on the duties and time commitment involved in the various council positions.

Moti= on 14        &= nbsp;           &nbs= p;         MS Bealo, Laughlin: The Faculty Senate accepts and supports findings in the re= port from the Tenure & Evaluations Review Board as the final report on the tenure status of Dr. Roya Lahijani. (Withdrawn)

        &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p; It was questioned whether it was appropriate to bring forward such a motion gi= ven that the Senate had already passed a similar motion several weeks ago.

        &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p; After additional discussion, Motion 14 was withdrawn.

Some Senators felt= that the Senate should ask the Tenure & Evaluations Review Board to review t= he matter again because they are the body authorized to consider matters relat= ing to tenure and evaluations. The TERB members are elected and trusted by facu= lty to have access to more information than Senators have due to the confidenti= al nature of these matters. Some Senate members felt strongly that the Senate = has already voted on this issue and that TERB had already reviewed its policies, procedures, timelines, etc. O= thers were confident that while TERB had undertaken the task previously they should be asked to revisit the matter and take into consideration whatever information has come since that time, including this recent ruling. Lengthy discussion followed on both sides of the issue by both Senators and guests including t= he fact that this matter was now really an issue to be addressed between the f= aculty member, PFF as the representative body and the district.<= /p>

Moti= on 15        &= nbsp;           &nbs= p;         MSF Kelber, Gowen: The Faculty Senate respectfully requests that the Tenure &am= p; Evaluations Review Board look at the recent ruling relating to the tenure of Dr. Roya Lahijani, see what can be learned from it, and make a recommendati= on if it so chooses. The Faculty Senate makes this recommendation without prejudice. Motion failed.

Moti= on 16        &= nbsp;           &nbs= p;         MS Laughlin, Nebelsick-Tagg: Faculty Senate acceptance of the recommendations = made by the Academic Standards and Practices Committee regarding the F, FW, Incomplete grades, and eighth week drop deadline.

        &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p; Teresa Laughlin outlined some of the proposed changes, including the recommendation that students may petition both an F and an FW to be changed to a withdrawal per BP 417.1. The conditions for withdrawal are unchanged.

        &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p; Discussion followed on the recommendations. Some Senators indicated that they liked the option of having the FW. Monika Brannick questioned the need for both the F= and FW, stating that it is possible for students to petition either one. Sue No= rton indicated that it is useful to have the option and give students the opportunity to provide the reason why they stopped attending a class. The instructor then has the option on how to proceed.

        &= nbsp;           &nbs= p;            &= nbsp;           &nbs= p; After further discussion, it was determined to bring this item back in the fall semester.

Gran= t:        &= nbsp;           &nbs= p;            &= nbsp;   Barb Kelber provided a written summary on the “Campus Explorations ’05-06: Ethics” grant at last week’s meeting. Katie Townsend-Merino reminded Senators that a letter of application is due on May 16. Invited applicants will then be notified to submit final proposals by October 20.
